In patent law, the date you file is the date the world stops counting against you. A provisional application secures that date for an invention that is still evolving — buying you twelve months to develop, test, raise funds and refine before the complete specification locks the claims.

Understanding provisional application filing

India's patent system rewards the earliest filer, and prior art is measured against your filing date. Every demo you give, paper you publish and pitch you make before filing is potential prior art against your own application. A provisional application is the instrument that flips that: file first, then talk.

A provisional needs no claims and can describe the invention as it currently stands — but "no claims required" is where most self-filed provisionals go wrong. The complete specification you file within twelve months can only claim what the provisional fairly discloses. A thin provisional gives you a priority date for less than you invented; the later-added material takes only the later date, and anything published in between cuts straight through it.

Our provisionals are therefore drafted as forward-looking documents: a specialist works out not just what you have built, but what the claims will eventually need to say, and makes sure the provisional's disclosure can carry those claims. Variations, alternatives and ranges are written in deliberately, because the version of the invention you ship in month eleven is rarely the version you described in month one.

The mistakes this service exists to prevent

The thin provisional

A two-page description filed in a hurry gives you a two-page priority date. Claims in the complete specification that reach beyond it take only the later date — and your own launch in between becomes prior art against them.

Treating twelve months as a soft deadline

The complete specification deadline is not extendable. Miss it and the application is deemed abandoned — with the provisional's disclosure now on the record.

Publishing the week before filing

The order of operations is everything. File first, publish second — even one conference slide the other way round can be cited against you.

Forgetting the foreign-filing rules

Indian-resident inventors need permission (or a six-week wait after an Indian filing) before filing abroad first. The penalty provisions are criminal, not administrative.

Does a provisional application give me enforceable rights?

Not by itself — no patent exists until grant. What it gives you is the priority date, the "patent pending" status, and a place in the queue. Damages, once the patent grants, can reach back to publication of the application, which is one more reason an early date matters.

Can I file a provisional myself and have you do the complete later?

Yes, and we regularly inherit self-filed provisionals. Be aware of the risk you carry in between: if the provisional's disclosure is thin, no drafting skill at the complete stage can recover the priority date for what it failed to describe. If you do self-file, use our document checklist tool and describe everything, including variations.

What does the government charge for a provisional?

The same application fee as any patent filing — the fee calculator on this site shows your category's amount. There is no separate "provisional fee"; the complete specification filed later does not pay the application fee again, though examination and other request fees apply when you reach them.

What if the invention changes completely during the twelve months?

If it has moved beyond what the provisional can support, we tell you honestly: sometimes the right move is a fresh application with a new date, sometimes a complete specification claiming the overlap plus new material at its own date. The mid-period review exists precisely to make that call with time to act.
